2. Prohibited Use. BY USING THE SERVICES, YOU AGREE NOT TO:
- Rely on information provided by Rentapartment Agency through the Services as the sole basis for any rental or real estate decision without first confirming the current details directly with Rentapartment Agency;
- Reproduce, modify, distribute, display or otherwise provide access to, create derivative works from, decompile, disassemble, or reverse engineer any portion of the Services, except as explicitly permitted under these Terms of Use;
- Provide/post/authorize a link to any of the Services (including but not limited to an agent profile page) from a third-party website that is not a real estate-related website owned or operated by a real estate professional or institution;
- Remove or modify any copyright or other intellectual property notices that appear in the Services;
- Use the Services for resale, service bureau, time-sharing or other similar purposes;
- Use the Services in any way that is unlawful, or harms Rentapartment Agency, its service providers, suppliers, or any other user;
- Distribute or post spam, chain letters, pyramid schemes, or similar communications through the Services;
- Impersonate another person or misrepresent your affiliation with another person or entity;
- Reproduce, publicly display, or otherwise make accessible on or through any other website, application, or service any reviews, ratings, and/or profile information about real estate or other professionals, underlying images of or information about real estate listings, or other data or content available through the Services, except as explicitly permitted by Rentapartment Agency for a particular portion of the Services;
- Upload invalid data, viruses, worms, or other software agents to the Services;
- Interfere with, or compromise the system integrity or security of the Services, or otherwise bypass any measures Rentapartment Agency may use to prevent or restrict access to the Services;
- Conduct automated queries (including screen and database scraping, spiders, robots, crawlers, bypassing “captcha” or similar precautions, and any other automated activity with the purpose of obtaining information from the Services) on the Services;
- Use any of Rentapartment Agency’s trademarks as part of your screen name or email address on the Services; or
- Attempt to, or permit or encourage any third party to, do any of the above.
3. Use of Content
Subject to the restrictions in these Terms of Use, you may copy information from the Services only as needed to view, save, print, or e-mail it for your personal or professional use (for example, a real estate market analysis). You may display and distribute derivative works of the aggregate data (for example, within a graph), so long as you cite Rentapartment Agency as a source on every page that displays the aggregate data, using wording such as “Data Provided by Rentapartment Agency.” The citation may not include a Rentapartment Agency logo without Rentapartment Agency’s prior written approval, and it may not imply any relationship between you and Rentapartment Agency beyond Rentapartment Agency being a source of the data.
4. Accommodation Listings
Rentapartment Agency publishes and maintains the accommodation listings available through the Services. Property owners may submit their properties for consideration, but Rentapartment Agency reviews and edits all listing information before it is published.
Listing information, including rental prices, availability, property features, amenities, services, and other details, is accurate as far as we know at the time we publish or update it. That information can still change without notice. Rental prices may go up or down, and a property shown as available may already be taken by the time you inquire. Before you make any rental decision, contact Rentapartment Agency to confirm the current availability, price, amenities, and other relevant details.
Rentapartment Agency takes the property photographs shown in the Services to give you a visual sense of the listed property. Unless we state otherwise, do not treat a photograph as a guarantee that the furniture, equipment, amenities, decorations, or other items shown will stay the same or be included on the same terms when you rent.
Rentapartment Agency is a real estate intermediary that connects prospective tenants with property owners. We are not the owner, landlord, or lessor of any property shown through the Services, and we are not a party to any rental agreement between a tenant and a property owner.
Submitting an inquiry, requesting more information, contacting Rentapartment Agency, or scheduling a viewing through the Services does not create a reservation, a booking, a rental agreement, or any guarantee that a property will stay available.
If Rentapartment Agency introduces you to a property or a property owner, you may not deliberately go around Rentapartment Agency to deal directly with the owner in order to cut us out of the transaction.
5. Links
The Services may contain links to third-party websites or resources. Rentapartment Agency does not control these sites and is not responsible or liable for (i) their availability or accuracy, or (ii) the content, products, or services they offer. A link does not mean Rentapartment Agency endorses that site or anything on it. You use any linked website or resource at your own risk and take sole responsibility for that use.
Some portions of the Rentapartment Agency platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to Google’s terms of use.
6. Proprietary Rights Notices
All trademarks, service marks, logos, trade names and any other proprietary designations of Rentapartment Agency used in these Terms of Use are trademarks or registered trademarks of Rentapartment Agency. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of their respective parties.
7. Feedback
If you choose to provide input and suggestions regarding the Services, including related to any Rentapartment Agency Materials (“Feedback”), then you hereby grant Rentapartment Agency an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve the Services or create other products and services.
8. Copyright Policy
Rentapartment Agency respects copyright law and expects its users to do the same. It is Rentapartment Agency’s policy to terminate, in appropriate circumstances, the Rentapartment Agency accounts of members or other account holders who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.
9. General
These Terms of Use are governed by the laws of Vietnam, without giving effect to its conflict of laws provisions. You agree to submit to the personal and exclusive jurisdiction and venue in Ho Chi Minh City for any and all disputes, claims and actions arising from or in connection with the Services and/or these Terms of Use. Rentapartment Agency operates the Services from its offices in Vietnam, and we make no representation that the Services are appropriate or available for use in other locations.
